走出小吃店就被攔！男吃燒酒雞上訴判免罰

日前在台北市有一名鄭姓男子，吃完燒酒雞，才剛離開小吃店，就被巡邏員警攔下，酒測值0.19毫克，已經超標。但他不服受罰，提起行政訴訟，法官判定，員警沒有「合理的理由」攔車，而且也無從判斷男子容易發生危害，改判不罰。

馬路上擺上三角錐，開始執行，攔檢勤務。

員警：「來摩托車靠邊停車檢查來，前面往前，靠邊停車檢查。」

設下攔檢點，摩托車一邊，汽車一邊，這是最常見不過的路檢；不過日前在台北市一名鄭姓男子消夜吃完燒酒雞騎車回家，結果是被一名執行巡邏勤務的員警攔下，酒測值0.19，鄭姓男子認為員警是故意等在小吃店外頭埋伏抓酒駕，他不滿收罰單，提出上訴。

法官勘驗蒐證畫面，認為巡邏員警沒有任何「合理懷疑」就「攔車酒測」，而且員警也說不出如何判斷男子騎車「易生危害」，只是先「攔了再說」才聞到騎士身上的酒味，判決撤銷罰單。

有些人聚餐吃熱炒就會喝點啤酒，比較擅長抓酒駕的員警就說，只要在熱炒攤小吃店附近攔查，會比一般路檢查獲酒駕的機會還要多，甚至清晨到旅館周邊也有可能查獲體內還有酒精殘留的駕駛人。其實酒駕被抓收到罰單事小，不開車上路不造成危害，才能讓自己和別人平安返家。
